We inform you that your personal data will be processed and stored by us in the manner described below and for the purposes set out below.

 

What will your data be used for?

The personal data collected from you on the basis of your registration with us or a request from you, received by any mode, will be used for the purpose of providing services to you as per the General Terms & Conditions. It is clarified that your data may be used for any purpose incidental or reasonably related to the aforesaid services or deemed to be essential for the provision of such services, as required by us. Without this information, we may not be able to provide the services requested by you.

In case of registration with us for any services, the data collected will be used for processing of such request and providing such services. The data collected will ve processed by Bhakti Bharat within the statutory provisions for advertising purposes and for statistical purposes.

We also store the personal data provided by you for customer care/relations e.g. information on change of any Government Policy, Visa, health regulations, information on travel services, tour schedules, execution of advertising and marketing measures within the legally permissible framework, queries and order processing.

Your data, apart from providing services to you, can also be used to comply with legal and regulatory requirements and to respond to inquiries from the Government of India and other such law enforcement agencies of India as part of an investigation, in accordance with the laws of the Republic of India.

 

What information will be collected by us?

The personal information that you provide us when you register with us and that you provide when you use our registration portal to register, or in any other manner or form, including the information that you provide us with by email such as:

  1. Salutation, First Name, Last Name,
  2. Date of birth,
  3. Place of residence
  4. Telephone number (landline and / or mobile)
  5. Email address
  6. Copies of passport with relevant personal details as mentioned on the passport including photo, serial number, address, nationality
  7. A photocopy of an identity card which is likely to include personal data such as name, photo, serial number, signature, address, nationality
  8. Specific categories of personal information, such as information about your state of health or your religious orientation, which you voluntarily indicate at the time of booking by entering a box in the health status, or enter it in any other field, such as by telephone at our customer service, in the telegram chat or during the booking process by email.
  9. Financial details including but not limited to bank account information, credit card information, insurance etc.

Your payment information, such as credit card number and expiration date (“Payment Information”), will also be collected by the respective banks and /or third party payment gateway while executing any transaction on our Website. This privacy statement does not apply to such banks and/or third party payment gateways.

All personally identifiable information you give us when registering and making the booking must be accurate. This includes, for example, that we always have your correct contact information (including e-mail address).

In addition, we may collect certain information automatically through cookies (including but not limited to web beacons and other technologies that collect information in a similar way to cookies), including, but not limited to, the type of device used to access the Website, the IP address of your device and other information that may be required for the smooth and efficient functioning of the Website. We may also use certain information to provide customer care services related to the provision of services.

The data we collect using cookies helps us understand our users better so that we can provide a more focused user experience. Using the knowledge of your previous visits to our website, we can enhance subsequent visits by tailoring our content to match your requirements.

The personal data will be collected as part of the pilgrimage booking and to fulfil the services, for contract communication and the IP address for verification and documentation purposes.

We may also analyse the data we have on business transactions, contracts, booked travel services in conjunction with usage data to increase the user-friendliness of our services, optimise our portfolio and to provide you with offers tailored to your interests. The analyses serve us alone and are not disclosed externally unless they are anonymous analyses with aggregated values.

Furthermore, the processing of the data available to us relating to business transactions, contracts, booked travel services in conjunction with usage data as well as the e-mail address and address of the travel applicant for the purpose of direct advertising is based on the legal basis of legitimate interest (Art. 6 (1) lit. f GDPR in conjunction with § 7 (3) UWG) or consent, Art. 6 (1) lit. a GDPR). To the extent you consent, we may also process your personal data for commercial use as set out above as well as to participate in the common experience during the pilgrimage (Art. 9 (2) lit. a GDPR).

Based on your consent

If you have given us separate consent to process your personal data, we will process your personal data within and on the basis of this consent. Consents may, for example, relate to the transfer of data to associated companies or third persons, the evaluation of your data for targeted advertising activities or sending of newsletters.

Consent is always freely given. Refusing or revoking your consent will not have any negative consequences for you.

When registering for Bhakti Bharat trips, etc., participants can decide whether they decide whether they may be filmed by the Bhakti Event video team or whether any recordings must be or whether any recordings need to be pixelated before they are made public. Bhakti Bharat and Bhakti Event GmbH have entered into a separate agreement for this activity. According to this agreement, Bhakti Event is responsible for the recordings and data protection of the virtual pilgrimage. Depending on the trips and activities offered , different personal data may be processed. Bhakti Bharat will disclose personal data to service providers to the extent necessary for the correct performance of the contract. According to the GDPR, this is a simple transfer of data between two separately data controllers.

For further details in this respect, please see section 1.3.-1.11. We are acting as with Bhakti Event GmbH regarding Virtual Pilgrimages, which is organised by Bhakti Event GmbH, and we are solely responsible and controller regarding life Pilgrimages which is organised by us, Bhakti Bharat.

1.3 Participating in a virtual pilgrimage

1.4 Which data do we process when you consent to a participate in a virtual pilgrimage?

If you give us a consent for the virtual pilgrimage via our website, we process from you, inter alia, first and last name, e-mail address, pictures, videos and testimonials, language of interpretation, spiritual name (optional), information about the pilgrimage you have registered for. We also process videos recordings of you while you participate in the pilgrimage to share the common experience with the whole participating (online and offline) community during a livestream and a period then after. In this process, the name by which you participate in the pilgrimage will also be displayed.
Moreover, we may use your photos and videos taken during the pilgrimage for the purpose of commercial use. This means your photos and videos may be used on our websites, in (print) publications and our Facebook, Flikr, Instagram page as well as our YouTube channel.

1.5 For what purposes and on what legal basis do we process this data?

The processing of photos and/or videos (collection, storage and transfer to third parties is based on the explicit consent of the person(s) entitled or the person(s) concerned, therefore in accordance with Art. 6 para. 1 letter a GDPR, Art. 9 Abs.2 lit.a GDPR. The processing is based on the legal basis of Art. 6 (1) lit. a GDPR (your consent, you have given. Consent is always freely given. Refusing or revoking your consent will not have any negative consequences for you. )  If you have signed a contract with Bhakti Event GmbH, with you as a participant regarding the virtual pilgrimage documentation production, then the contract is the legal basis Art. 6 (1) b GDPR.

Lionheart Squared ltd. 2 Pembroke House, upper Pembroke Street 28-32, Dublin, DO 2 EK84, Irland email: zoom@LionheartSquared.eu, it  shall be stored on specially protected servers. In this context, the software hexaglobe and Zoom conference is the processor of the parties within the meaning of Article 28 of the GDPR. The parties each undertake to conclude a contract pursuant to Art. 28 GDPR with regard to the processing of the personal data for which they are responsible. Bhakti Event  GmbH and  Bhakti Bharat undertakes to provide the data subjects with the information to which they are entitled pursuant to Article 15 GDPR on request. If Bhakti Bharat receives a request for information, it undertakes to forward this request immediately to Bhakti Event GmbH without culpable hesitation.

1.7 Categories of possible recipients of the personal data:

The photos and/or videos can sometimes be shared with Facebook Instagram , YouTube. For purposes of public relations, as well as commercial use and sales work, they may be posted on the homepage of bhaktimarga.org and used for the Facebook page, Twitter page, You-Tube Channel of Bhakti Event GmbH.

1.8 Duration of storage of personal data:

Photos and/or videos, which are made for the purpose of public relations, as well as sales work of Bhakti Event GmbH, will be stored for an indefinite period of time for a specific purpose, subject to revocation of consent by the data subject(s) if you have signed a contract , according to the contract.

The consent to the processing of the photos and/or videos can be revoked at any time for the future with future effect. The data subject can exercise their withdrawal rights vis-a-vis Bhakti Event GmbH via the following email dataprotection@bhaktimarga.org. The legality of the data processing carried out on the basis of the consent until the revocation is not affected by this. In case of a contract with you as a participant is signed, regarding the production of the virtual pilgrimage, than a contract is the legal basis for the processing of your data according to Art. 6 I b GDPR.

1.11 Data subject rights:

According to the General Data Protection Regulation, you are entitled to the following rights: Data subjects may assert the rights to which they are entitled under Articles 15 to 22 of the GDPR against both contractual partners Bhakti Event GmbH and Bhakti Bharat.

  1. If your personal data are processed, you have the right to receive information about the data stored about you. (Art. 15 GDPR)
  2. If incorrect personal data is processed, you have the right to rectification (Art. 16 GDPR).
  3. If the legal requirements are met, you may request erasure or restriction of processing, as well as object to processing (Art. 17, 18, 21 GDPR)
  4. If you have consented to the data processing or a contract for data processing exists and the data processing is carried out with the help of automated procedures, you may have a right to data portability. (Art. 20 GDPR)

If you make use of the aforementioned rights, the controller will check whether the legal requirements for this are met. Furthermore, you have the right to lodge a complaint with the Data Protection Commissioner of the State of Hessen.

This takes place in the form of a negative or positive decision or a determination of identity. In the case of a positive decision in accordance with Art. 15 of the GDPR, the data subject will be provided with complete detailed information. An email confirmation will be sent by WordPress with the request for confirmation of the request for deletion as a security mechanism and serves the purpose of establishing identity. We implement a variety of security measures designed to maintain the safety of your personal data we store and process.
